Collective Bargaining:  Notice to bargain was served on October 31, 2016. It is required by law to serve notice before the current contract expires. It is still my preference to have a cooling-off period with the CRA before embarking on the next round of negotiations, and I have communicated that to the CRA.  On the former contract, signing bonuses were issued on November 30, and retroactive payments were issued in January/February. Also in January, options letters for the payments in lieu of severance were issued. We are on track for full implementation within the 150-day requirement. Management agreed with our request for more detailed payment information to accompany these payments, as Phoenix is seriously deficient in that regard.  There has been some improvement and we will continue to lobby for more details.

Our priority now is a campaign to lobby the Government to return the CRA to its former independent bargaining status.  We have proven in the past this is the best for the Agency and its employees. This message was clearly articulated by our 2nd National Vice-President to The Minister of National Revenue, Diane Lebouthilier, when she met with our Executive Council on December 8, 2016. The UTE Political Action Committee has launched a lobbying campaign on this theme.

The 2nd National Vice President, Madonna Gardiner, and I have had preliminary discussions on the re-opener clause of our current collective agreement. She is having conversations with the PSAC Negotiator, Morgan Gay, and will report accordingly.

BILL C-10 CHALLENGE- In mid-August, the Ontario Court of Appeal upheld the Ontario Superior Court decision that Bill C-10, the Expenditure Restraint Act, did not violate our Charter rights. Bill C-10, passed by the former Conservative government in 2009, rolled back negotiated wage increases for our members for years 2011 and 2012. In mid-October, the PSAC applied for leave to appeal this decision to the Supreme Court of Canada. According to the PSAC, our chances of being granted leave are 50-50. The main obstacle to not being granted leave to challenge for us is the fact that the Supreme Court has already heard the challenge of the Expenditure Restraint Act that was filed by the RCMP (not a union).

PHOENIX ISSUES- Our members continue to suffer as a result of the new Phoenix pay system. To alleviate that suffering, I have struck an Ad Hoc Committee that will address those issues with CRA management. Their first meeting was November 2 and 3, 2016, where issues were identified in order to be referred to the CRA. The committee subsequently met with the CRA in December 2016, where the issues identified were presented.  This concludes the work of this ad hoc committee.

AGMS: As can be easily seen from my itinerary, the AGM season is upon us once again. We would ask the Locals to coordinate their AGMs with other Locals in the same region to facilitate travel by our National Officers and to ensure a National Officer presence at every AGM.
    
UTE TRIENNIAL CONVENTION:  The Convention call was issued in early January 2017. Please keep the deadline dates in mind as we enter into this hectic pre-Convention period. The deadlines for both participant registration and resolutions is this Saturday, March 11 2017. Convention Committees are scheduled for April 28-30,2017. Please refer often to the Convention 2017 section of our website. During the December, Executive Council meeting, the Convention per diem rates (must be approved by the convention) and the Convention Registration amount were approved.  The Host Committee Chair will make a presentation during the March Presidents’ Conference.

AEU Collective BARGAINING: I am pleased to report that we have concluded a collective agreement with the staff in late December, 2016.

Meetings with CRA:  Meetings with the CRA have resumed in earnest, since the moratorium on joint consultations was lifted last year. However, we have a long way to go to return to full, meaningful consultations. My relationship with the Commissioner at this time is quite strained and we are hoping for some improvement.  We were not able to hold a NUMCC (National Union-Management Consultation Committee) meeting in December, as the resumption of meetings resolution came too late for a December NUMCC to be scheduled. We expect to return to the NUMCC table in June of 2017. However, several sub-Committee meetings were held, on issues of staffing; Compensation; WFA;UMA; EAP, etc.  

WEB/COMMUNICATIONS:

We are continuing our preparations for convention and have ordered the convention banner and other items.  We have moved our website to a new hosting platform that provides better support.  There were minimal issues with the transition and our website is working well. We have been adding missing texts and translations for past years.  This is an ongoing process.

INFORMATION TECHNOLOGY:

All IT systems have been running well. Regular software maintenance of internal computers, servers and network was performed.

GRIEVANCES:

Since our last Executive Council meeting, the National Office received fifty-six (56) grievances, other than classification.

During the same period, seventy-two (72) grievances were presented dealing with a variety of issues, including mostly hours of work. In this quarter, we received twenty-seven (27) grievance replies from CRA, one (1) of which was allowed and twenty-six (26) were denied.  Two (2) grievances were withdrawn by the grievor and/or UTE and two were settled by Memorandum of Understanding.

  1. Grievance held in abeyance at request of PSAC pending judicial review of WSIB appeal. Grievances still awaiting information from ATIP.  Complaint will be filed with the Privacy Commissioner.
  2. Grievance recently presented. Awaiting reply.
  3. Fifty-one (51) of these grievances are related to hours of work and 10 are related to PSTAR. Discussions are ongoing with the CRA before the grievances are presented.
  4. Hours of work grievances presented on February 3rd, 2017.
  5. Two grievances are being held in abeyance at the grievor’s request pending a CHRC complaint. The remaining 4 grievances are pending due to settlement discussions with the employer.
  6. Two grievances are held in abeyance at the request of grievor and legal counsel pending the grievor’s criminal trial. Three other grievances are held in abeyance pending the completion of an MOA that will exist until Sept 2017. Two grievances are pending settlement discussions and two are held in abeyance at the request of the grievor.
  7. Grievances settled, but will not be withdrawn until all terms of the agreement have been affected.

There are presently one hundred and seventy-six (176) grievances in the National Office inventory which have not yet been presented at the Final Level. Included in this number are fifty-three (53) grievances dealing with Hours of Work, ten (10) with PSTAR and twenty (20) with Article 19.

As has been previously mentioned, with respect to the 10 PSTAR grievances, we have recently concluded a Memorandum of Settlement and these grievances will be withdrawn when the terms of the settlement are implemented.
