Collective Bargaining:   There have been no meetings held or movement from CRA in regards to our collective bargaining. We do have some hope of returning to the table with the election of a new government on October 19th 2015. The government has made some positive statements about treating public servants with respect and also in investing in the Canada Revenue Agency. We can only hope that this is sooner rather than later. I have written a letter to the new Minister of National Revenue, Diane Lebouthillier, asking for a meeting. I have not yet had a reply at the time of writing this report. We have also started a grievance campaign to put pressure on the CRA and Treasury Board to return to the table. These protest grievances are going well and the more we file the better, as it is in support of the bargaining team.

HISTORY OF UTE: We have engaged the Workers’ History Museum to produce a book and a video on the history of UTE. Both projects are on track and the book and video have progressed to the final approval and translation stages. We are still scheduled for completion and release in March of 2016.

UTE’s 50th ANNIVERSARY:  As we enter our 50th year, we are planning on organizing some celebrations to mark the occasion. Exact details have not been decided and we will provide further information at a later date.

AGMS: The AGM season is starting up again in most regions. Once again, we would ask the Locals to coordinate their AGMs with other Locals in the same region to facilitate travel by our National Officers and to ensure a National Officer presence at every AGM.  

Meetings with CRA:  We have had several meetings with CRA during this period mostly on several staffing related issues and Human Resources Policy changes. Due to the deteriorating relationship with CRA management and the current state of your contract negotiations, UTE nationally will continue to not participle in the Union/Management Consultation Committee meetings until a fair Collective Agreement is reached. 

Web/Communications Report:

We continue to update our website.  Adding the older content and fixing some of the content migration issues is an ongoing process.  Overall we have received positive feedback from our website visitors.

Information Technology:

All IT systems have been running well. Regular software maintenance of internal computers, servers and network was performed. We purchased new computers for the staff at the national office as part of our scheduled computer refresh. We renewed our Office365 licenses for another year.

GRIEVANCES

Since our last Executive Council meeting, the National Office received four hundred (402) grievances, other than classification. Included in this number are twelve (12) groups of grievances relating to PSTAR pension (130), hours of work (152), job description (15) and Article 1 (74).

During the same period, fifty-three (53) grievances were presented dealing with a variety of issues. In this quarter, two (2) grievances were withdrawn, one by UTE and the other by the grievor and we received forty-two (42) grievance replies from CRA of which three (3) were partially allowed and thirty-nine (39) denied.

There are presently three-hundred and eighty-four (384) grievances in the National Office inventory which have not yet been presented at the Final Level.


  1. Grievor was originally identified by the CRA as being an employee of Shared Services Canada (SSC) at time of grievance.  Employee has been confirmed as an SSC employee and the grievance is held in abeyance at the request of the grievor pending changes to the SSC classification system.
  2. Grievance held in abeyance at request of PSAC pending judicial review of WSIB appeal.
  3. Job content grievance – settlement discussions ongoing.
  4. Replies held in abeyance at the request of the grievor.
  5. Waiting for information on these grievances.
  6. Grievances recently presented and replies are pending.
  7. Grievances held in abeyance pending immigration investigation.
  8. Ten job content grievances hearings held on September 16, 2015.  Responses should be issued shortly.  The remaining grievance is a termination and settlement discussions are ongoing.

INDEPENDENT THIRD PARTY REVIEWS (ITPRs)

During this quarter, three new ITPRs were received in the National Office concerning staffing. After further review, a decision was made not to provide representation for two of these ITPRs.

The Federal Court decision concerning one application for judicial review of a decision from a previous quarter was received during this quarter and was successful, resulting in the reinstatement of the requestor.

There are currently two (2) staffing ITPRs in our inventory requiring representation by the National Office.
