Collective Bargaining:   The UTE and the CRA Negotiating Teams met with the Mediator on March 30, 31 and April 1, 2015. A National Day of Action was held on March 18th. We had great participation from across the country. It was certainly noticed by management that the members are not going to just take a nothing offer and they want to be treated fairly.

A National Tweeting Campaign was started on April 29 and is ongoing. This did garner a response from the Commissioner that CRA is ready to negotiate a fair collective agreement. This response from the Commissioner was not well received by the membership. We must continue to support the team and keep relaying to management that we are not willing to roll over. The next scheduled dates for mediation are May 20 and 21, which are subsequent to the writing of this report.

IMPACT OF THE 2015 BUDGET: Once again the Harper Government has introduced an Omnibus Bill as part of their budget. Again they have included legislation that is aimed at taking away collective bargaining rights from civil servants.  The government’s plan for changes to the Public Service Sick Leave Plan does not affect the members of UTE at this time, but we know that we must join into this fight now. This shows another important reason to go out and exercise your right to vote and pick your employer.

PSAC CONVENTION: The PSAC Convention was held from April 24- May 1, 2015 in Quebec City. The mandate for the next three years was set, with a dues increase of .29 cents per member per month.  The Convention also approved a 5 million dollar line item for political action and to fight the attacks on our collective bargaining rights. Congratulations to Sister Robyn Benson and Brother Chris Aylward on being re-elected to their respective positions.

HISTORY OF UTE: We have engaged the Workers’ History Museum to produce a book and a video on the History of UTE. The work has begun and we will keep you advised of the progress.  I am very excited about this project as it is of paramount importance to preserve our history and our achievements. Many over the years have worked tirelessly for the members of UTE and this should be remembered.

NATIONAL OFFICE STAFFING:   We are currently running selection processes for a Determinate / Indeterminate LRO position and a Determinate/ Indeterminate Assistant Finance Officer position. Sister Monique Desrosiers has accepted a position with another Component and we wish her all the best.

AGMS: The National Officers are still attending Local AGMs across the country. The feedback from the AGMs is that the membership is engaged and wants information. There is tremendous support for the bargaining team. The members understand that the decisions that will be made in the near future are very important and will affect not only themselves, but future employees of CRA.

Meetings with CRA:  We have had several meetings with CRA during this period mostly on several staffing related issues and Human Resources Policy changes. Due to the deteriorating relationship with CRA management and the current state of your contract negotiations, UTE nationally will continue to not participle in the Union/Management Consultation Committee meetings until a fair Collective Agreement is reached. 

WEB/COMMUNICATIONS: We have launched our new website.  There are still some changes to make and we have to complete the grievance system, but for the most part the project is done.  We hope you like the new site.

INFORMATION TECHNOLOGY: All IT systems have been running well. Regular software maintenance of internal computers and servers was performed. We replaced our Bell mobile phones with newer versions of Blackberry and Apple smartphones. We are working at replacing the audio visual equipment in the main boardroom at the National Office.

Since our last Executive Council meeting, thirty eight (38) grievances, other than classification, were received at the National Office.

During the same period, fifty-five (55) grievances were presented dealing with a variety of issues.  Two (2) grievances were withdrawn.  In this quarter, we received sixty-four (64) grievance replies from CRA: one (1) grievance was settled; one (1) was partially allowed; four (4) were withdrawn and fifty-eight (58) were denied.

There are presently sixty-three (63) grievances in the National Office inventory which have not yet been presented at the Final Level.  

[1] Grievor was originally identified by the CRA as being an employee of Shared Services Canada (SSC) at time of grievance.  Employee has been confirmed as an SSC employee and the grievance is held in abeyance at the request of the grievor pending changes to the SSC classification system.

[2] Grievance held in abeyance at request of PSAC pending WSIB appeal.  WSIB appeal is being handled by legal services of PSAC.

[3] Job content grievances awaiting hearing dates from employer

[4] Waiting for grievor's comments (delayed until end of May 2015)

INDEPENDENT THIRD PARTY REVIEWS (ITPRs)

During this quarter, no new ITPRs were received in the National Office concerning staffing.

One application for judicial review of a decision from a previous quarter is still pending at the Federal Court.  No date for a hearing has been scheduled yet.

There are currently six (6) staffing ITPRs in our inventory requiring representation by the National Office.  Two are scheduled for June and three are scheduled for July.

Our office continues to receive multiple requests for ITPRs, but after a review of the grounds and circumstances by our officers, it has been determined that many of them do not qualify for ITPR.  For the most part, it appears that members are attempting to request ITPRs when they are screened out or when they have not passed the assessment phase.  We remind local representatives and members that members who are screened out may only avail of individual feedback and those who have failed the assessment stage may only avail of individual feedback, followed by decision review.
