Collective Bargaining:   The Public Interest Commission (PIC) was held October 8th and 9th in Ottawa. I was proud to attend with some twenty UTE members from the area. Thank you to all that attended and showed support for the team. Also, I would like to thank all the Locals from across the country that held activities to show support for the team. It was greatly appreciated. There was 100 percent engagement from all the Locals.

My feelings and comments on the PIC were distributed to all Locals. As of the writing of this report, the 30-day time limit for the decision from the PIC has expired and we await the report. We have dates tentatively set for December and February to try and negotiate a fair collective agreement.   We had some good front-page press coverage right after the PIC with the headline “Tax Union Refuses to Give up Severance, Sick Leave”, in the Ottawa Citizen.
 
We must continue to support the team and keep relaying to management that we are not willing to roll over.
 
HOTEL REQUIREMENTS: Our current contract with the Fairmont Chateau Laurier runs out the end of 2015. We are in the process of reviewing proposals from four hotels for the next three-year cycle.
 
NATIONAL OFFICE STAFFING:  We would like to welcome Sister Andrea Holmes to the National Office staff as an indeterminate Labour Relations Officer. We are currently running a selection process for an Administrative Support position.  We hope to have this completed and staffed before the end of 2014.
 
AGMS: The National officers have started to attend local AGMs across the country and I would like to thank the Locals for working together on the dates. The feed back from the AGMs is that the membership is engaged and wants information. There is tremendous support for the bargaining team. The members understand that the decisions that will be made in the near future are very important and will affect not only themselves, but future employees of CRA.        

Meetings with CRAWe have had several meetings with CRA during this period mostly on several staffing related issues. Due to the deteriorating relationship with CRA management and the current state of your contract negotiations, UTE nationally will continue to not participle in the Union/Management Consultation Committee meetings until a fair Collective Agreement is reached. 

WEB/COMMUNICATIONS: All of the information on the website is up to date.  The UTE calendars were sent out to all of the locals at the end of October.  We have been working with our web developers to design the new look and feel of the website and to create new logos for all of the committees.  We expect to launch the new website before the next Executive Council meeting.

INFORMATION TECHNOLOGY:  All IT systems have been running well. Regular software maintenance of internal computers and servers was performed. We purchased a new Dell server to replace an out of warranty server. We renewed our Teamviewer license (software used to provide remote support) and our Exchange Online subscription for another year. We are in preliminary discussions with Xerox about upgrading our printers at the National Office.

GRIEVANCES:

Since our last Executive Council meeting, seventy (70) grievances, other than classification, were received at the National Office.

During the same period, twenty-five (25) grievances were presented dealing with a variety of issues.  Six (6) grievances were withdrawn.  In this quarter, we received twenty (20) grievance replies from CRA all of which were denied.  One file from a previous quarter was reconsidered and reopened.

  1. Grievor was originally identified by the CRA as being an employee of Shared Services Canada (SSC) at time of grievance.  Employee has been confirmed as an SSC employee and the grievance is held in abeyance at the request of the grievor pending changes to the SSC classification system.
  2. One grievance held in abeyance at request of PSAC pending WSIB appeal and one grievance held in abeyance pending mediation.  WSIB appeal is being handled by legal services of PSAC.
  3. Four grievances were being held pending a request for information under ATIP.  This information has now been received and a hearing date secured for mid-December. A presentation date has now been secured for one and a MOS is still in the process of getting signed. 
  4. Six grievances are being held pending a request for information under ATIP.  Twelve other grievances dealing with WFA will be withdrawn and we are awaiting notices of withdrawal from the grievors.

There are presently one hundred and seventeen (117) grievances in the National Office inventory which have not yet been presented at the Final Level. Many of these grievances relate to the same subject matter and are considered groups.

There was no policy grievances filed during this period.

ACS-SP CLASSIFICATION CONVERSION GRIEVANCES

All forty-three (43) grievances have been presented and replies have been received.  As a result, we will no longer provide further reporting on this matter.

INDEPENDENT THIRD PARTY REVIEWS (ITPRs)

During this quarter, there were no new ITPRs received in the National Office concerning staffing.  Three decisions were received and all were dismissed.  One of these is being referred to Federal Court on an Application for Judicial Review.

There are currently six (6) staffing ITPRs in our inventory requiring representation by the National Office and four (4) non-staffing which have been referred to the PSAC for representation.  Included in the six are two groups of two ITPRs concerning the same selection process. The remaining two ITPRs are from individual members concerning individual selection processes.

Our office has received multiple requests for ITPRs, but after a review of the grounds and circumstances by our officers, it has been determined that many of them do not qualify for ITPR.  For the most part, it appears that members are attempting to request ITPRs when they are screened out or when they have not passed the assessment phase.  We remind local representatives and members that members who are screened out may only avail of individual feedback and those who have failed the assessment stage may only avail of individual feedback, followed by decision review.
