THANK YOU/COMMITMENTS: This is my first Executive Council report as your National President and I want to start by telling you how proud I am to be part of this great union that is the UTE.

Having been elected UTE National President at our last triennial Convention is truly an honour for me. I am taking this opportunity to thank the delegates who attended the July Convention for their incredible support and for their vote of confidence.

Thank you to all the people that supported me and worked so hard to help me get where I am today. I am enthusiastic about the idea of working closely with the Executive Council Officers and with our Locals to keep defending with passion the interests of all our members and ensuring that the employer feels that we are a force to be reckoned with.

I know what great responsibilities I have taken over.

I commit to represent and lead our union for the betterment of all the membership for the next three years. I am committed to serving all our members to the best of my knowledge, to sparing no effort and to listening and exhibiting leadership. I am also committed to providing my support and assistance to all our union representatives, both local and regional, for helping them carry out their duties.

I firmly believe that our Component was and still is the best of all the Components that make up the Public Service Alliance of Canada (PSAC). The Union of Taxation Employees is an excellent union with a great tradition. However, I believe that there is always room for improvement. Therefore, I am committed to doing everything in my power to improve our communication within the UTE and with our members. Likewise, I intend to boost our political lobbying and our media presence when it proves necessary. I am also committed to working closely with the leaders of the PSAC and the other Components and with the PIPSC-AFS group.

I would also like to point out that I intend to work very hard to improve our relationship with the employer and do so at all levels.

Since being elected, one of my first major decisions was to appoint my Executive Assistant. Brother Daniel Camara was appointed to this key position. I am certain that he will be a great asset for our National Office, our members and our organization as a whole.

The last few years have been very tough with the budget cuts and the last round of bargaining, but we have shown that, when we stand together, we can accomplish a great deal and achieve our objectives. I am aware that a great many challenges are before us. There are, of course, all the impacts from the Service Renewal Initiative undertaken by the CRA last fall and the outcomes of which we don’t yet know at this time. Rest assured that we will keep representing our members and defending their interests in this matter as we have done in many other instances.

I will always make all of my decisions based on what is best for the membership. I make a pledge to do everything in my power to never let you down.

Let’s move forward together!

CONVENTION 2017: The Triennial Convention was held in Ottawa, Ontario from July 19-22, 2017. The body dealt with all of the concurrence resolutions and some of the non-concurrence resolutions. We passed a budget for the next three years and elected the new National Officers. A big thank you must go out to the Ottawa Locals for the hard work of their members on the Host Committee, and for their great hospitality. Also, I would like to thank the members and retired members that came forward to work as door tilers. This was a successful convention with good, meaningful debate and discussions on the topics. All of the delegates were respectful and engaging on the convention floor.

I would like to thank all of the candidates who put their names forward for consideration as National Officers. I welcome the newly elected National Officers, and I wish them well in their mandate. Thank you to those National Officers who are not returning. Your work, dedication and commitment to the members are greatly appreciated.

Conventions are a tremendous amount of work and effort, both before and during the event. Our National Office Staff, as always, went above and beyond to pull off a great Convention. I would like to personally, and on behalf of the Union, thank them for all of their hard work and dedication. Everyone of the staff stepped up and did whatever was asked of them, from preparation and packing in the National Office prior to the Convention, to working Registration, to working the store.

I must acknowledge Brother Shane O’Brien, and Sisters Pierrette Labrie and Annette Melanson for their leadership and dedication. Without all of these people, we could not have had such a successful Convention.    

COLLECTIVE BARGAINING:

Regarding the last round of bargaining: The issues that arose upon the settlement of the last collective agreement, those being the Appendix G-Memorandum of Understanding on scheduling issues and the Letter of Understanding on staffing issues, have seen opposite success.  The Appendix G- MOU Ad hoc Committee has managed to meet and consult with the Employer on scheduling matters, although their work is not yet complete. The LOU Ad Hoc Committee on various staffing issues has been completely and utterly unsuccessful, due mostly to the weak or non-existent commitment on the part of the employer.  UTE therefore decided in late June to collapse this Committee, and will instead pursue the issues raised in this forum at the bargaining table in the upcoming round of negotiations.

Wage Reopener Clause: Our PSAC/UTE Bargaining Team met with the CRA on May 3rd and 4th to discuss wage increases for 2014 and 2015, consistent with our collective agreement signed last year. Unfortunately, we were unable to reach an agreement over the two days and therefore proceeded to the next step under our contract and the law – to discuss and agree upon an arbitration process.

After several meetings and on-going correspondence between the parties, we agreed upon an arbitration process in July. We are now in the process of selecting an arbitrator. Once that’s completed, the arbitrator will set dates to hear our dispute, and will subsequently render a decision.

Regarding the next round of bargaining: Notice to bargain was served on October 31, 2016. It is required by law to serve notice before the current contract expires. The input call to receive bargaining demands was sent in March and the deadline for receipt was June 1, 2017. In the immediate future, the National Bargaining Committee will meet to discuss, select and prioritize our demands. The new Bargaining Team will be selected and will proceed to negotiations with the CRA.

AGMs: The next round of Annual General Meetings (AGMs) will begin in October 2017 and run through May of 2018. I will make a concerted effort to attend as many of them as I can. It is extremely beneficial for the National President to listen to the members first-hand and hear their views on the different issues that concern them. If I cannot make an AGM, we will make every effort for the First or Second National Vice-President to attend, as it is very important for the National Office to be represented at the Locals’ AGMs. I would ask the Locals located in the same region to coordinate their AGMs in order to make the best use of the National Office staff and resources.

PSAC 2018 CONVENTION: The National Board of Directors (NBoD) of the PSAC has approved the Convention Call at their last meeting and I have been advised that it should be issued by the end of September. The Convention will be held in Toronto, Ontario at the Metro Toronto Convention Centre from Sunday April 29 to Friday May 4, 2018. Our UTE Caucus will be held on the Sunday. The opening plenary session will start on Monday morning.

NATIONAL OFFICE STAFFING:  

We have appointed Sister Chantal Beauchamp to an administrative support position in order to fill the void left by the retirement of Sister Louise James. Sister Beauchamp began working for us on the Monday that Convention started. Talk about an induction by fire. She has successfully met the challenge and we are pleased to be able to count on her.

2017 CANADA REVENUE AGENCY CHARITABLE CAMPAIGN (CRACC):

The Union of Taxation Employees’ (UTE) position regarding the 2017 Canada Revenue Agency Charitable Campaign has evolved.

This year, UTE National will participate with CRA officials to the launch and promotion of the 2017 campaign. We are strongly encouraging our Regional Vice-Presidents and Locals to participate as well.

The Public Service Alliance of Canada (PSAC) is working with the officials at the United Way to make sure that the Unions and their members will get the recognition that they deserve for their contributions to the CRACC.

Once again, we are encouraging our members to be generous by continuing to donate to charitable organizations. They can do it through the CRACC or directly with the United Way or to UTE’s charitable organization of choice, the International Children’s Awareness Canada (ICA).

Together, let’s help those people in need!

Meetings with CRA:  Meetings with the CRA have resumed in earnest, and we held our first National Union Management Consultation Committee (NUMCC) meeting on June 15, 2017, after a hiatus of 2 years. Several sub-Committee meetings were held, on issues of Staffing, Compensation, and Health and Safety. As well, I have met personally with CRA’s Commissioner Bob Hamilton and the Assistant Commissioner of Human Resources, Dan Couture. I have also had a telephone conversation with the Deputy Commissioner, Nancy Chahwan.  We are all committed to a return to meaningful consultations.

GTA SERVICE MODERNIZATION:

On June 28th, the CRA Ontario Region announced the Greater Toronto Area (GTA) Service Modernization plan.  This plan caused significant concern within our membership in the Greater Toronto Region. These concerns are shared by the National Office of the Union of Taxation Employees.

Immediately after being made aware of this plan, UTE attempted to obtain full disclosure from the employer at the National and Regional levels.  The National Office, Regional Vice-Presidents, Local representatives and members have been actively discussing and consulting with the CRA regarding this issue.  The collective action has led to a renewed commitment from the CRA, delaying the implementation model and instituting a consultation framework over the course of the next few months, allowing employees to provide details of their particular situations, personalized options, ideas and suggestions for moving forward.

To this end, a meeting was held at the National level on September 7, 2017 to discuss and establish a consultation approach and framework regarding the development of a new organizational model within the Greater Toronto Area (GTA) Tax Services Offices.

Furthermore, a Regional GTA Consultation Working Group has been established to collect employee input and feedback on the design and subsequent implementation approach of a new organizational model for the GTA. Brothers Ken Bye and Cosimo Crupi, respectively Regional Vice-President for the Greater Toronto and Northern/Eastern Ontario regions, sit on this working group. The working group held its first meeting in the afternoon of September 7, 2017. They will meet on a regular basis throughout this process, taking into consideration all feedback received from employees.

We are committed to collaborate with the employer and the PIPSC-AFS group representatives regarding this initiative and to keep our members informed of any development throughout this process.

Discussions between UTE representatives and CRA officials will continue to take place on a regular basis at all levels.

I guarantee you that UTE will continue to help and support its locals and its members in order to minimize the impacts associated with this initiative.

WEB/COMMUNICATIONS:

At convention, we took photos and produced daily summaries.  These were well received by those unable to attend convention.  Once back in Ottawa, we were hard at work updating the website with the many changes in leadership, both at the national level with a new President and 1st Vice-President; and at the regional level with changes to four of the Regional Vice-Presidents.  Most of the received updates to the website have been made and there are only a few outstanding items.

INFORMATION TECHNOLOGY:

All IT systems have been running well. Regular software maintenance of internal computers, servers and network was performed. We renewed the licenses for our Cisco Meraki network equipment.

GRIEVANCES:

Since our last Executive Council meeting, the National Office received one hundred twenty-two (122) grievances, other than classification.

During the same period, one hundred thirty-three (133) grievances were presented dealing with a variety of issues, including 118 PSTAR grievances representing a group of 158 grievors.  Seventeen (17) grievances were withdrawn, with seven (7) of these withdrawals resulting in Memoranda of Settlements. In this quarter, we also received two hundred and one (201) grievance replies from CRA, mostly replies to the PSTAR and One Time Leave grievances, all of which were denied.

There are presently seventy-four (74) grievances in the National Office inventory which have not yet been presented at the Final Level dealing with a variety of issues.

  1. Grievance held in abeyance at request of PSAC pending judicial review of WSIB appeal.
  2. Grievances are being held in abeyance at the grievor’s request pending a CHRC complaint.
  3. Two grievances are held in abeyance at the request of grievor and legal counsel pending the grievor’s criminal trial. Two grievances are pending settlement discussions and two are held in abeyance at the request of the grievor.
  4. Waiting implementation of MOA.

POLICY GRIEVANCE

There were no new policy grievances filed during this period.

Statutory Freeze Complaints

During this quarter, we finally received the reply from the PSLREB concerning the Statutory Freeze Complaint concerning Hours of Work filled on behalf of our members in Atlantic Canada. This complaint was allowed and we are currently discussing corrective measures with the employer. Despite these discussions, the employer has filed an application for judicial review of this decision in the Federal Court.

A further and separate Statutory Freeze Complaint has been filed on behalf of our members in Sudbury with respect to another arbitrary and unilateral decision by the employer, again concerning Hours of Work.
