PSAC appealing decision on Bill C-10, the Expenditure Restraint Act
In 2009, PSAC challenged the constitutionality of the Expenditure Restraint Act which rolled-back existing collective agreements in the federal public service and imposed restraints on the rates of pay that could be negotiated in collective agreements during the restraint period.
This case was argued in October and November 2013 and we received the decision dismissing our case in February.
The Court relied on the fact that the ERA applied to both unionized and non-unionized employees as the basis for upholding the legislation’s constitutionality. PSAC submitted an appeal of that decision on March 13, 2014.
