UTE RESOLUTIONS
TO PSAC CONVENTION 2006


1.  PSAC CONSTITUTION REGULATION 15 – RATIFICATION VOTES

WHEREAS several members and Locals have complained about the length of the ratification process; and

WHEREAS this long period reduces members’ interaction momentum and the activism of Locals; and

WHEREAS this ends up not reflecting the reality of members’ needs versus the employer’s offers; and

WHEREAS most articles in the tentative agreement are in both official languages.

BE IT RESOLVED THAT PSAC amend its Regulation 15 such that the ratification vote process and the announcing of the results for the CRA and other employers not belonging to the Treasury Board, who request it, be completed no later than 30 days following the date of the tentative agreement.


2.  PSAC CONSTITUTION REGULATION 15

WHEREAS PSAC regulation 15 provides for the establishment of a Strategy Coordinating Committee/National Strike Coordinating Committee; and

WHEREAS elected union officers and members have a vested interest in the success of any collective bargaining process; and

WHEREAS those PSAC staff who have been assigned to those committees and actively participate in those committees do not share the same vested interest.

BE IT RESOLVED THAT PSAC Regulation 15 be amended to provide that the membership of the strategy coordinating committee/national strike coordinating committee shall be composed of the AEC officer assigned to that unit, the Component President(s) involved, members of the Component(s) National Executive and representatives of the bargaining team members.  All PSAC staff assigned to those committees will attend in an advisory capacity, may provide reports, administrative and or coordinating assistance but will not participate in decision making.

3.  INCREASE % AVERAGE RATION FOR STRATEGIC STRIKE PAY

WHEREAS during the last year’s strike activities, the PSAC has resorted more and more to the use of strategic strike; and

WHEREAS members who are on strategic strike should not unduly suffer financial hardship; and

WHEREAS the ratio of gross to net pay is closer to 70% as opposed to 60%.

BE IT RESOLVED THAT PSAC amend it’s rate of strategic strike pay to 70% of gross salary.

4.  PSAC REGULATION 15 – BACK TO WORK PROTOCOL

WHEREAS PSAC Regulation 15.2.1 states the National President has the ultimate authority in the area of strikes; and

WHEREAS this regulation also states the National President is also the only person who may authorize a bargaining unit to return to work following strike activity.

BE IT RESOLVED THAT PSAC Regulation 15 include a back to work protocol; and

BE IT FURTHER RESOLVED THAT this protocol state the National President will determine the specific time/day that a bargaining unit(s) shall return to work.

5.  ACCOUNTABILITY TO REGIONS OF STRIKE CO-ORDINATING COMMITTEE

WHEREAS communication problems were evident during the past labour dispute; and

WHEREAS some regions felt that their input was ignored by the Strike Co-ordinating Committee; and

WHEREAS it is important that strike activities be tailored to fit the diverse regions in this country.

BE IT RESOLVED THAT PSAC Strike Co-ordinating Committee be more accountable to the regions by allowing them more appropriate and timely input on strike proposals and actions.

6.  BARGAINING EDUCATIONAL VIDEO

WHEREAS some members do not know the difference between the PSAC’s bargaining processes and the one used by other regional or local unions, and this creates a great deal of confusion; and

WHEREAS video is an effective means of educating or informing.

BE IT RESOLVED THAT PSAC produce a video document or have one produced to show how bargaining is done and all the steps that the bargaining process must follow; and

BE IT FURTHER RESOLVED THAT this video be available before March 2007.

7.  PSAC CONSTITUTION – DESIGNATED MEMBERS PAYMENTS

WHEREAS the PSAC Constitution (Section 24, Subsection (7)) establishes the requirement for designated members to remit 25% of the remuneration they receive during a legal strike to the Alliance; and

WHEREAS neither the PSAC Constitution nor its Regulations provides specific guidelines or procedures for the collection of these payments

BE IT RESOLVED THAT PSAC develop specific guidelines on the procedure applicable for the collection of the payments by designated members.

8.  COMMUNICATION

WHEREAS daily information being distributed to the members during the strike of 2004 was often late or non-existent; and

WHEREAS an educated membership on the strike line makes a stronger front and boosts morale; and

WHEREAS information on the PSAC website was limited on strike days; and

WHEREAS management had more current and timely information before the membership.

BE IT RESOLVED THAT PSAC provide more detailed and timely information to the membership outlining all strike activities for that particular day; and

BE IT FURTHER RESOLVED THAT PSAC provide this information in the form of bulletins for daily distribution to the membership on the line.

9.  HEALTH CARE PLAN

WHEREAS our members are increasingly being prescribed ergotherapy and remedial learning; and

WHEREAS these treatments are not covered by Sun Life;

BE IT RESOLVED THAT PSAC take the steps required for getting these ergotherapy and remedial learning treatments covered and reimbursed by the Public Service Health Care Plan.

10.  VISION CARE

WHEREAS the costs have increased dramatically for vision care.

BE IT RESOLVED THAT PSAC put pressure on the appropriate party so that the limits for vision care, especially lenses, be increased.

11.  SUPERANNUATION (REDUCTION)

WHEREAS we pay into our pension benefits and it’s a return on our investments; and

WHEREAS we also pay into CPP/QPP.

BE IT RESOLVED THAT PSAC lobby the government to change legislation so that when we the pensioners reach 65 the superannuation payments are not reduced by the CPP/QPP benefits.

12.  PSAC EQUITY / HUMAN RIGHTS CONFERENCES

WHEREAS the majority of the components that hold Equity and/or Human Rights Conferences do so as a whole, thus not separating the equity groups.

BE IT RESOLVED THAT PSAC hold one National conference to further Equity/Human Rights issues instead of four separate National Equity Conferences; and

BE IT FURTHER RESOLVED THAT the total of the current funding allocated to the four National Equity Conferences be used to fund the one National Equity and/or Human Rights conference; and

BE IT FURTHER RESOLVED THAT caucuses be held for each of the separate equity groups at the National Equity and/or Human Rights Conference so as to not minimize the individual equity group issues.

13.  PSAC NATIONAL BOARD OF DIRECTORS

WHEREAS elected members of the PSAC National Board of Directors must report on their activities at every PSAC National Board of Directors meeting; and

WHEREAS the report they currently submit does not promote and is not specific about the work they do.

BE IT RESOLVED THAT in addition to the usual report currently submitted to the NBOD, that a detailed activity report also be provided during NBOD meetings by the elected members of the PSAC AEC (President, National Vice-Presidents and Regional Executive Vice-Presidents).

14.  SCENT FREE POLICY

WHEREAS many PSAC members have environmental sensitivities; and

WHEREAS all PSAC members have the right to a safe workplace.

BE IT RESOLVED THAT PSAC place priority in the development and delivery of education on scent-free workplaces for its members; and

BE IT FURTHER RESOLVED THAT PSAC lobby appropriate levels of employer governments and separate employers to jointly develop and implement scent-free policies, including an ongoing education program.

15.  PSAC CONSTITUTION – VOLUNTARY WITHDRAWL OF PSAC MEMBERSHIP

WHEREAS only PSAC members are subject to the PSAC Constitution, Component By-Laws and/or Local By-Laws; and

WHEREAS a member may avoid possible disciplinary proceedings, discipline or participating in a legal strike of their bargaining unit by voluntarily withdrawing their membership in the PSAC.

BE IT RESOLVED THAT PSAC constitution be amended to provide a 60 day period for the withdrawal of membership to take effect from the date of receipt by the PSAC National Office of that notice.

16.  PSAC CONSTITUTION – JURISDICTION

WHEREAS the CRA is now on it’s own; and

WHEREAS it is in the best interests of members to be served by components that are fully aware of their wants and needs; and

WHEREAS the FOUNDING reason for the PSAC having COMPONENTS was to better represent members working for separate departments.

BE IT RESOLVED THAT PSAC Constitution be amended to allow the President of the PSAC to reallocate members of Components along the business lines of the employer where it is in the best interests of the member(s), subject to review by the National Board of Directors of the PSAC.

17.  PSAC CONSTITUTION – PSAC REGIONAL CONVENTIONS

WHEREAS PSAC does not currently fully fund all delegates to their respective PSAC Regional Conventions; and

WHEREAS many potential delegates are prohibited from participating due to high costs, especially those who live outside of the geographical area in which their Convention is being held; and

WHEREAS Alliance Executive Officers are elected at these Conventions and the voice of all members, through their delegates, should be assured in all electoral processes.

BE IT RESOLVED THAT PSAC fully fund all delegates to their respective PSAC Regional Conventions.

18.  PSAC CONSTITUTION – PSAC TRIENNIAL REGIONAL CONVENTION

WHEREAS representation by population is a basic union principle; and

WHEREAS delegate entitlement to PSAC regional Conventions is not based on representation by population in all PSAC regions.

BE IT RESOLVED THAT subsection 16(4) of the PSAC Constitution be amended so that representation at PSAC triennial Regional Conventions be as follows: that each Component or Directly Chartered Local be entitled to one (1) delegate for the first 200 members and one (1) additional delegate for each additional 100 members or fraction thereof.

19.  PSAC CONSTITUTION – STRIKE STRATEGY

WHEREAS strategy is vital during strike action; and

WHEREAS the premature release of strike strategy can be detrimental to its effectiveness; and

WHEREAS the release of such information should be considered a serious offense and breach of confidentiality.

BE IT RESOLVED THAT PSAC Constitution, Section 25, Subsection 5 be amended to include a provision whereby disciplinary action can be taken against a member(s) who releases strike action strategy, that is determined to be detrimental to the cause.

20.  PSAC CONSTITUTION – NEW

WHEREAS there are times during the bargaining process where information blackouts are advisable;

BE IT RESOLVED THAT the PSAC Constitution Regulation 15 be amended to add:

“At no time during the bargaining process, up to and including a final offer or settlement shall any officer or member of the PSAC disclose any bargaining information without having prior consultation and consent of the bargaining team.  A contravention of this part would constitute an action subject to disciplinary measures.”

21.  PSAC CONSTITUTION

BE IT RESOLVED THAT the Alliance transfer all service delivery functions to components upon request, save and except collective bargaining, organizing, the functions of the Legislative Office and necessary administrative functions (e.g. Membership); and

BE IT FURTHER RESOLVED THAT PSAC dues structure be amended to return the monies associated with the cost of performing the aforementioned services to those components who intend to perform those functions and have made the applicable request.
